LIMSCAPERS End User License Agreement (EULA)

This End User License Agreement ("Agreement") sets forth the terms and conditions for the use of the web-based service "LIMSCAPERS" ("Service") provided by SMOOTHEA Corporation ("Company"). By using this Service, users are deemed to have agreed to this Agreement.

Article 1 (Scope of Application)

This Agreement applies to all users of the Service. Users who do not agree to this Agreement may not use the Service.

Article 2 (User Registration)

  1. To use the Service, users must create an account by following the registration procedures specified by the Company.
  2. If false or misleading information is provided during registration, the Company may suspend or delete the account.
  3. Users under the age of 13 must obtain parental or guardian consent before using the Service. The Company may request age verification or confirmation of such consent when necessary.

Article 3 (Intellectual Property Rights)

  1. All intellectual property rights related to the Service (including software, structure, UI, text, images, etc.) belong to the Company or rightful third parties.
  2. Users are prohibited from reproducing, distributing, transmitting, adapting, or otherwise using the contents of the Service without permission.

Article 4 (User-Generated Content)

  1. Users guarantee that they hold all necessary rights for any content ("User Content") uploaded or posted to the Service.
  2. The following types of content are strictly prohibited:
    • Content that infringes on copyrights, trademarks, portrait rights, or other third-party rights
    • Sexual or adult content
    • Discriminatory, hateful, or harassing content
    • Excessively violent or grotesque content
    • Content that violates laws or public order and morals
  3. Users are solely responsible for resolving any disputes with third parties regarding their User Content and shall hold the Company harmless.
  4. The Company reserves the right to remove or make private any User Content that is deemed to violate this Agreement without prior notice.
  5. By submitting User Content, users grant the Company and other users a non-exclusive, worldwide, royalty-free license to reproduce, distribute, modify, display, and utilize such content within the Service and the LIMSCAPE game environment.

Article 5 (Prohibited Conduct)

Users must not engage in the following activities:

  • Registering false or impersonated information
  • Defaming, threatening, or discriminating against others
  • Posting obscene, sexual, violent, or discriminatory content
  • Posting spam, bulk content, or automated submissions
  • Uploading viruses, malware, or malicious code
  • Any other activity deemed inappropriate by the Company

Article 6 (Disclaimer)

  1. The Service is provided "as is" without warranty of completeness, accuracy, or continuity.
  2. The Company assumes no responsibility for damages caused by viruses, malware, data loss, or any issues arising from downloaded files (including .LIMSCAPE files).
  3. The Company is not obligated to store or back up User Content. Users are responsible for managing their own data backups.

Article 7 (Suspension and Deletion of Accounts)

  1. If a user is found to be in violation of this Agreement, the Company may suspend or delete the account or make posted content private without notice.
  2. Repeat violators of this Agreement or copyright infringers may be permanently banned at the Company’s discretion.

Article 8 (Copyright Infringement Claims)

  1. If you believe that content on the Service infringes your copyright, please contact us at contact@limscape.com with the following:
    • Information about the copyrighted work being infringed
    • URL or Post ID of the allegedly infringing content
    • Your contact information and proof of ownership or representation
  2. Upon receiving a valid notice, the Company may remove or temporarily hide the content in question.

Article 9 (Modifications to the Agreement)

The Company reserves the right to change this Agreement at any time without prior notice. Changes become effective once posted or announced through the Service.

Article 10 (Governing Law and Jurisdiction)

This Agreement shall be governed by the laws of Japan. Any disputes related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
